1. Acceptance of Terms

By accessing or using the mypeach platform ("Platform", "Service"), you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Platform. We reserve the right to modify these Terms at any time; continued use constitutes acceptance.

2. Age Restriction — 18+ Only

mypeach is an adult wellness platform intended exclusively for users aged 18 and above. By creating an account, you represent and warrant that you are 18 years of age or older. We reserve the right to immediately terminate any account where there is reasonable belief that the user is a minor, without notice and without refund. Any misrepresentation of age is a material breach of these Terms.

3. Nature of the Service

mypeach provides a private digital wellness platform that includes:

• AI Companions: Conversational AI personas designed for emotional support, companionship, and wellness guidance.
• Community: A moderated forum for peer support and shared experiences.
• Educational Content: Videos and resources related to sexual health, relationships, and well-being.

Important disclaimers:

• AI companions are artificial intelligence systems — they are not real people, not licensed therapists, not doctors, and not counsellors.
• Content on this platform is for general wellness and educational purposes only. It does not constitute medical, psychological, legal, or professional advice.
• Do not use this platform in place of professional medical or mental health treatment. If you are experiencing a crisis, please contact a qualified professional or emergency services immediately.

4. User Conduct

You agree not to use the Platform to:

• Post or transmit any content that is illegal, defamatory, harassing, threatening, or abusive
• Share content involving minors in any sexual or inappropriate context — this is strictly prohibited and will be reported to law enforcement
• Impersonate any person or entity or misrepresent your identity
• Scrape, copy, or reproduce platform content without written permission
• Attempt to reverse-engineer, hack, or disrupt the Platform or its infrastructure
• Use the Platform for commercial solicitation or spam
• Harass, bully, or intimidate other users
• Upload malware, viruses, or any malicious code

Violation of these rules may result in immediate account suspension or termination and, where applicable, referral to law enforcement.

5. Adult & Sensitive Content

mypeach operates in the domain of sexual wellness and adult companionship. By using the Platform, you acknowledge and accept that:

• You may encounter content of a sexual or adult nature
• All such content is intended for consenting adults aged 18 and above
• You access this content voluntarily and of your own free will
• You will not share, screenshot, or distribute any Platform content, including AI conversations, to minors or in any public forum without explicit permission

mypeach does not produce or distribute obscene, illegal, or non-consensual content. All AI interactions are designed to promote healthy attitudes toward sexuality and well-being.

6. User-Generated Content

By posting content to the community (posts, comments, reactions), you grant mypeach a non-exclusive, royalty-free, worldwide licence to display and moderate that content within the Platform. You retain ownership of your content. You represent that your content does not infringe any third-party rights. We reserve the right to remove any content that violates these Terms or our community guidelines, without notice.

7. Intellectual Property

All Platform content — including but not limited to the AI systems, design, branding, videos, and written material — is the exclusive property of mypeach or its licensors and is protected under applicable intellectual property laws. You may not copy, reproduce, redistribute, or create derivative works from any Platform content without our express written consent.

8. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, mypeach, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, emotional distress, or relationship harm — arising from your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising under these Terms shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) INR 1,000 / USD 12.

10. Indemnification

You agree to indemnify and hold harmless mypeach and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit.

11. Account Termination

We reserve the right to suspend or permanently terminate your account at our sole discretion, with or without notice, for any violation of these Terms or for any conduct we deem harmful to the Platform, other users, or our reputation. You may delete your account at any time through your profile settings. Upon termination, your right to access the Platform ceases immediately.

12. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of India. You agree to attempt to resolve disputes informally by contacting us first at support@mypeach.club.
